IEEPA Tariff Refunds – Next Steps & Keeping You Informed [CLIENT ALERT]

As of March 6, 2026, Customs and Border Protection is preparing to process IEEPA tariff refunds but lacks current guidance. Gallagher is ready to assist clients with the refund process once more information is available.
- Customs and Border Protection informed the Court of International Trade that they are not yet ready to process refunds. Gallagher is preparing data for clients to file once guidance is provided. Importers are encouraged to register for an ACE account for electronic refund transfers.
- As of March 6, 2026, Customs and Border Protection (CBP) let the Court of International Trade (CIT) know that it was not prepared to process the court-ordered IEEPA tariff refunds but could have ACE ready to do so in the next 45 days.

IEEPA tariff refunds refer to the reimbursements related to tariffs imposed under the International Emergency Economic Powers Act. As of March 6, 2026, Customs and Border Protection indicated that they were not ready to process these refunds but expect to have the Automated Commercial Environment system prepared within 45 days to facilitate this.

U.S. Customs & Border Protection is creating a new functionality that will allow CBP to issue refunds and interest payments faster by combining entries by importer rather than individual entries.

What’s Next?
- We recommend that importers register for an ACE account and ACH Refunds with the CBP. CBP has mandated that all refunds will be transferred electronically via ACE.
- Once ACE is running, Gallagher will assist importers with gathering relevant information on which IEEPA duties were paid.
- Once ACE runs a series of validations on each entry, it will re-calculate the duty owed without the IEEPA tariffs.
- CBP will then verify it and process refunds as soon as possible.
